It was a great honour to have been invited by the Department of Justice to speak at National Security Legal Forum on the topic: “Clearing up confusion and misunderstandings – Hong Kong’s endeavors in safeguarding national security”.
筆者非常榮幸獲律政司邀請，在國家安全法律論壇，以“正本清維護國安法律體源—香港維護國家安全的實踐歷程”為題作出演講。
Focusing on the role of HKSAR to continuously refine and improve our legal system and enforcement mechanism for safeguarding national security, I talked about three legislative exercises in 2025 and this year which illustrate HKSAR’s efforts in safeguarding national security while adhering to the rule of law and protecting human rights, demonstrating the alignment with the White Paper titled “Hong Kong: Safeguarding China’s National Security Under the Framework of One Country, Two Systems”(“the White Paper”).
筆者針對不斷完善維護國家安全的法律制度和執行機制的職能，詳述了2025年及今年的三項立法實踐，實證了香港特區在維護國家安全的同時，兼顧法治精神與人權保障，與《“一國兩制”下香港維護國家安全的實踐》白皮書(《白皮書》)高度銜接、要義一致。
In all three legislative exercises, independent judicial power plays the gatekeeper role to ensure powers of the authorities are subject to checks and balances. On the other hand, in regard to the 2nd and 3rd legislative exercises, similar laws are not uncommon in other jurisdictions, some of which allow for exercise of powers without judicial authorization.
在三項立法工作中，獨立的司法權均發揮了“把關者”的角色，確保權力的行使受到監督與制衡。另一方面，就第二及第三項立法工作而言，類似的法律在其他司法管轄區亦屢見不鮮，其中部分司法管轄區甚至容許在未經司法授權的情況下行使相關權力。
The HKSAR strictly abides by the Constitution, the Basic Law, the HKNSL and local laws. As the White Paper stated, the Hong Kong has been resolutely fulfilling its constitutional responsibility to safeguard national security by continuously forming a comprehensive legal framework in which the Hong Kong NSL and local legislation are closely aligned and function as an integrated whole.
香港特別行政區嚴格依照憲法和基本法、香港國安法以及本地法律開展工作。
正如《白皮書》指出，香港特別行政區堅決履行維護國家安全的憲制責任，完成一系列本地立法，構建了香港國安法和本地法律緊密銜接、構建了香港國安法和本地法律緊密銜接、渾然一體的特別行政區維護國家安全的法律體系。
